Supreme Court of the State of New York

In 2007, the State Insurance Fund sued Harry’s Nurses Registry in New York Supreme Court (Index No. 406555/07) for $122,729.01 in unpaid workers’ compensation premiums, plus interest and a $27,000.38 collection fee.
On July 8, 2011, Justice Milton A. Tingling denied the Fund’s motion for summary judgment. The Fund hadn’t shown when the policy was actually cancelled, and the company said it had switched to another insurer on May 25, 2007. The Fund also gave no proof of its real collection costs, which State Finance Law § 18 requires.
